    Personal Information” as used in this Privacy Policy, means any personal information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly with a particular user or household. We collect Personal Information that you voluntarily provide to us when you express an interest in obtaining information about our products and Services, when you participate in activities on the Site, or when you contact us.

    In order to use our Services, you must provide certain Personal Information. Over the past twelve (12) months, we have collected the following information:

    • Information You Provide to Us. We collect information from you when you voluntarily provide it to use through the Site and/or Services, including as part of registering for an account or creating a resume. Information provided includes your full name, email address, telephone number(s), address, profile picture, driver’s license type, your LinkedIn profile URL, URLs of any websites you include on your resume.
    • Protected Class Information. Due to the specific nature of the Services, you may be asked to provide information about your nationality, gender, date of birth, place of birth, and marital status.
    • Education and Employment Information. We collect information about your educational background, employment, employment history, and salary.
    • Transaction and Payment Information. Payment information is collected from you when you order Services through the Site or contact us regarding a prior transaction. We use the Third Party Payment Processors, including but not limited to, Adyen, PayPal, Stripe, and Mollie Payments, to process payments. Your payment details will be provided directly to the Third Party Payment Processor, but may share certain information with CVmaker (e.g. your name, payment details, or bank details) so that we can confirm payment. The Third Party Payment Processors are the data controllers for the payment data provided by users through the Site.
    • Content You Make Public. We collect information from you when you voluntarily post or upload it to the Site and/or Services for public display (“Public Information”), including when you post a review, comment on the Services, or participate in a forum on the Site. Once you submit Public Information, neither you nor CVmaker are able to control how it may be copied, shared, or used by third parties, even if you and/or CVmaker later delete such Public Information.     • Device/Internet Connection Information. When you use the Site, we automatically gather information made available by your web browser (such as Microsoft Edge or Google Chrome), internet service provider (such as Comcast or Cox), and device (such as your computer, phone, tablet, or fitness tracker), depending on your settings for each. For example, we may collect your IP address, information about the operating system or type of device you use, the device ID associated with your device, the date and time you access the Website, and your log in attempts.
    • Internet Activity Information. We may collect information about your browsing history, search history, and information regarding your interaction with a particular website, application, or advertisement, including our Site. We may collect information regarding the websites, applications, or advertisements you visited immediately before and after your use of the Site.
    • Geolocation Information. We may collect information about where you are located, both generally and at the time you access the Site. For example, we may collect your mailing address or ascertain your approximate location from your IP address.
    • Inference Information. CVmaker may create new information about you by drawing inferences from the information identified in the categories listed above, such as to create a profile about you reflecting your preferences, characteristics, predispositions, and behavior.
    • Other Information. From time to time, we may collect other information from you, such as when you make a claim for a prize pursuant to a contest or other promotion run on the Site, when you request assistance through customer service, or when you voluntarily subscribe to promotions, reminders, or newsletters. You will always be asked for your consent in advance of providing such other information, and we will not collect it without your permission.
  3. How and When We Collect Information

    CVmaker gathers information about you through the following sources and means:

    • When you enter or upload information to the Site. We collect information you provide to us, protected class information, education and employment information, transaction and payment information, content you make public, and geolocation information when you enter such information on the Site (including during registration), purchase products or services, sign up for newsletters or promotional material, enter contests, upload content, post in a forum, and otherwise interact with the Site.
    • When you communicate with us. We may also collect information you provide to us, protected class information, education and employment information, transaction and payment information, content you make public, and geolocation information from you outside of the Site, such as when you contact our customer service department, email us (including any response to an email communication from CVmaker), or communicate with us via social media, such as by posting on a page hosted by CVmaker or tagging us in your own post. The information collected outside of the Site may be combined with information collected from the Site—for example, if you use the Services and later contact CVmaker regarding the Services, the information collected in both interactions may be linked.

    Cookies” are small, simple text files that your computer or mobile device stores when you use any website, including our Site. We use various types of cookies, some of which are placed by Third Parties, to customize your experience on the Site, keep you logged into the Site, remember information you have entered, and to advertise products or services to you. We use the following types of cookies:

    • Functional Cookies. We use functional cookies to ensure the Site functions properly. Functional cookies are used to identify you, prevent security risks, and to allow you to perform account-related functions. The following functional cookies are placed by third parties:
      • Postmark. Postmark provides use with our email service. All emails you receive from CVmaker are sent by Postmark. By using Postmark, we can ensure that emails always arrive in your inbox. We have a processing agreement with Postmark for the provision of its services. Postmark receives user email addresses and the content of emails from CVmaker. Postmark never uses the information collected for its own purposes and Personal Information is securely stored. Postmark uses tracking cookies and other technologies in the emails it sends, which provide insight into when emails are opened and read and at what IP location. Postmark’s data is stored in the US and deleted after sixty (60) days. More information about how Postmark processes data processing can be found in the Postmark Privacy Policy.
    • Analytics and Performance Cookies. We use analytics and performance cookies to collect information about how you and other users interact with the Site. By understanding how users interact with the Site, we can continuously optimize and improve our Site. Analytics cookies store data including IP addresses, browser used, screen resolution, language preferences, surfing and scrolling behaviors on the Site, pages visited on the Site, and which website brought you to the Site. CVmaker uses the following analytics cookies:
      • Google Analytics. With Google Analytics we are able to measure your use of the Site. Google does not share (anonymous) data with third parties. These cookies are automatically deleted after a maximum of 2 years. More information about data processing can be found in the Google Privacy Policy.
      • Hotjar. With Hotjar we anonymously measure your scrolling and clicking behavior. With this information we can detect errors in the Site and continue to improve our services and the Site. Hotjar does not share (anonymous) data with third parties. These cookies are automatically deleted after a maximum of one (1) year. More information about Hotjar’s data processing practices can be found in the Hotjar Privacy Policy .
      • Tawk. Tawk offers chat services on the Site. CVmaker collects the contact details of the person being chatted with and the content of the conversations. This information is used to assist you when you contact us through our live chat. The data is stored in the US and is deleted after thirty (30) days. Tawk does not share (anonymous) data with third parties. More information about Tawk’s data processing practices can be found in the Tawk Privacy Policy .
      • Tapffiliate. Tapffiliate may place cookies to measure whether you access our Site from a partner. This data is used to measure from which campaign your visit originated. Tapfilliate does not share (anonymous) data with third parties. These cookies are automatically deleted after a maximum of ninety (90) days. More information about Tapffiliate’s data processing practices can be found in the Tapfilliate Privacy Policy .
    • Marketing Cookies. We use marketing cookies and web beacons, including those placed by third parties, to deliver personalized ads that may be of interest to you. We may also use web beacons in email messages sent to track your response. Cookies and web beacons also help us, and our third-party advertising partners ensure you do not see the same advertisements over and over and to identify and block unwanted ads. We also use these tracking tools to better understand your behaviors and browsing activities, and to generate inference information, as discussed in Section 2. CVmaker uses the following cookies set by our third-party advertising partners:
      • Google Remarketing and DoubleClick.     Information” as used in this Privacy Policy refers to both Personal Information and information that is automatically collected. We process your Information for purposes based on legitimate business and commercial interests, the fulfillment of our agreement with you, compliance with our legal obligations, and/or your consent.     Scope and Legal Bases for Use

    CVmaker only processes your information to the extent it is necessary to accomplish the above-stated business and commercial purposes, which serves as our legitimate interest. If you reside in a location governed by the GDPR, then the following are CVmaker’s legal bases for the processing of your information: In so far as we have obtained consent for processing operations of information by the data subject, Art. 6(1) lit. a GDPR serves as the legal basis. For the processing of information necessary for the performance of a contract to which the data subject is a party, Art. 6(1) lit. b GDPR serves as legal basis. The same applies to such processing operations which are necessary for carrying out pre-contractual measures. In so far as the processing of information is required to comply with a legal obligation to which our Company is subject, Art. 6(1) lit. c GDPR serves as legal basis. In the event that processing of information may be necessary to protect the vital interests of the data subject or of another natural person, Art. 6(1) lit. d GDPR serves as legal basis. If processing is necessary for the purposes of the legitimate interests pursued by our Company or by a Third Party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject, processing operations are based on Art 6 (1) f DSGVO.

    We do not share your Information with third parties unless it is necessary to fulfill our business or commercial obligations, to provide you with services, to protect your rights, with your consent, or if it is required by law.

    Service Providers. Various third parties provide services to CVmaker that allow us to operate the Site and Services. For example IT service providers, email service providers, research agencies, payment partners, and live chat platform providers.

    Affiliated Entities. Affiliated entities are different than third parties in that they are businesses that are directly related to us and have common ownership with us. We disclose, transfer, and share your Information to our affiliated entities, in which event, your Information shall be treated by the affiliated companies in accordance with this Privacy Policy. Should we be subject to an acquisition, merger, sale or other change of control or business entity status, we reserve the right to transfer or assign your Information as part of that acquisition, merger or sale.

    Government Officials/Legal Process. We may be required to disclose your Information in response to subpoenas, court orders, and other legal processes. In very rare circumstances, we may disclose Information when we believe it is necessary to prevent illegal, fraudulent, or injurious actions that may cause harm to individuals.

  7. Sale of Data
    For all users outside of California, recruiters and companies use our Services to search for potential candidates for employment. As such, any information that is included in your Account profile, including your name, title, professional information, general location, biography, and completed resume may be shared with them.  Because we may receive advertising or other revenue from such recruiters and companies in exchange for providing access to this information, this feature of the Website may constitute a “sale” of personal information.  Of course, if you would like to opt-out of the share of your information with recruiters and companies, you may select the “Do Not Share Option” in your Account or contact us at [email protected].

    California users are exempted from the records made available to recruiters and companies.  If you have identified yourself as a California resident (i.e., through use of a California IP address or by providing us with a California street address), then we do not (and have not for the past twelve (12) months or longer) sell any of your personal information.
  8. Data Retention

    We only retain the data of users who have completed steps 1-2 of the Services. If a user does not subsequently complete use of the Services or sign up for a Subscription, the data will be stored for one (1) month. Information will be deleted after one (1) month.

    If you complete use of the Services, i.e., create a finalized resume or cover letter, or sign up for a subscription, we will retain your information for the length of time necessary to fulfill the business or commercial purposes outlined in this Privacy Policy, unless a longer retention period is required or permitted by law or valid court order. If you request deletion of your information, your request will be processed according to the timeframes indicated in this Policy.

  9. Security and Protection of Information

    CVmaker takes appropriate technical and organizational security measures to protect your personal data. Among other things, we use SSL technology to encrypt transmission of sensitive information or personal data to us, such as account passwords and other payment-related identifiable information. In addition, all sensitive information is encrypted. Moreover, this information can only be accessed by employees for whom it is necessary to access.

    However, no system can be completely secure.  Therefore, although we take steps to secure your information, we cannot promise, and you should not expect, that your personal and commercial information, or other communications, will always remain secure.

    The safety and security of your information also depends on you. Never share your password with anyone else and notify us as soon as possible if you believe your account security has been breached.

  10. Information Transfer

    If you are visiting the Site from a location outside of the Netherlands, your connection will be through and to servers located in the Netherlands, and all information you provide will be processed and securely maintained in our web servers and internal systems located within the Netherlands. By using the Site, you authorize and specifically consent to the transfer of personal data to the Netherlands and its storage and use as specified above when you provide such information to us.

You have the right to ask us to delete or remove your Personal Information, including when you withdraw your consent. If we have shared your Personal Information with third parties, we will inform them of the request to delete where possible.

Right to Restrict Processing

You have the right to request that we restrict or block the processing of your Personal Information in certain circumstances, such as when you contest the accuracy of the Information or object to us processing it. We will tell you before we lift any restriction on processing. If we have shared your Personal Information with third parties, we will inform them of the restriction where possible.

Right to Data Portability

You have the right to obtain the Personal Information that you consented to provide or that was provided as necessary in connection with the Services. We will provide your Personal Information in a structured, commonly used and machine-readable format.

You have the right to request that we stop processing your Personal Information.

Rights of California Residents

If you are a resident of California, you are granted specific rights regarding access to your Personal Information.

You may access all Personal Information we’ve collected and retained about you for purposes of correcting, amending, downloading, or deleting such information. Access can be obtained by contacting us at [email protected].

To protect your privacy and security, we may take reasonable steps to help verify your identity before granting access, making corrections, providing you with information, or deleting information.

California Shine the Light Disclosure

Under California’s “Shine the Light” law, California residents who provide Information to the Site may request certain information regarding our disclosure of your Information to third parties for their direct marketing purposes. To make such a request, please contact us at [email protected].

Cal. Bus. & Prof. Code § 22581 Disclosure

If you are a California resident under the age of 18, and a registered user of any Site where this Privacy Policy is posted, California Business and Professions Code Section 22581 permits you to request and obtain removal of content or information you have publicly posted. Please be aware that such a request does not ensure complete or comprehensive removal of the content or information you have posted and that there may be circumstances in which the law does not require or allow removal even if requested.

Right to Non-Discrimination

We will not discriminate against you if you exercise your privacy rights under the CCPA.

Upon receiving your request, we will need to verify your identity to determine you are the same person about whom we have the information in our system. These verification efforts require us to ask you to provide information so that we can match it with information you have previously provided to us. For instance, depending on the type of request you submit, we may ask you to provide certain information so that we can match the information you provide with the information we already have on file, or we may contact you through a communication method (e.g. phone or email) that you have previously provided to us. We may also use other verification methods as the circumstances dictate.

We will only use personal information provided in your request to verify your identity or authority to make the request. To the extent possible, we will avoid requesting additional information from you for the purposes of verification. If, however, if we cannot verify your identity from the information already maintained by us, we may request that you provide additional information for the purposes of verifying your identity, and for security or fraud-prevention purposes. We will delete such additionally provided information as soon as we finish verifying you.

You can designate an authorized agent to make a request under the CCPA on your behalf. We may deny a request from an authorized agent that does not submit proof that they have been validly authorized to act on your behalf in accordance with the CCPA.

Protecting the Privacy of Children

CVmaker will never knowingly collect any personal information about children under the age of 13. If we obtain actual knowledge that we have collected personal information about a child under the age of 13, that information will be immediately deleted from our database. Because we do not collect such information, we have no such information to use or to disclose to Third Parties. We have designed this policy in order to comply with the Children’s Online Privacy Protection Act (COPPA).

Receiving and Opting Out of Marketing Communications

By providing your email address through the Site or sending CVmaker an email, you consent to receive emails from us, including information concerning your account and advertising messages. Depending on your location, we may obtain additional consent from you via checkbox disclosures or an email requesting confirmation before you can receive such information.

Providing consent to promotional emails is not a condition of purchasing any goods or services from CVmaker. You can unsubscribe to advertising emails at any time by clicking the unsubscribe link within the email, or by contacting us at [email protected]. Please note that, even if you unsubscribe from advertising emails, we will still send you necessary, non-promotional emails about your purchases, account, or updates to our Privacy Policy or Terms and Conditions.

Do Not Track (DNT) Signals

DNT is a feature offered by some browsers which, when enabled, sends a signal to websites to request that your browsing is not tracked.  We do not currently respond to DNT requests.

Disclaimer

This Privacy Policy does not apply to the data processing practices of Third-Party Sites that may be linked to the Site. We are not responsible for how these third parties handle personal data. We recommend that you read the privacy statement of these websites before continuing your use. We are not liable for damage resulting from unlawful access to computers or files obtained by third parties, viruses distributed through advertisements or other unlawful programs or files.
